Experience

Casey spent his first 19 years at an international law firm before joining Sanders Warren & Russell. He has been repeatedly named to Super Lawyers, Best Lawyers, Best of the Kansas City Bar. He is AV-rated by Martindale Hubbell and American Lawyer’s Magazine. 

As a trial lawyer with over 27 first-chair jury trials, he defends professional and product liability matters, mass tort and business disputes nationwide.  Twice, his jury trials resulted in defense verdicts among the largest in Missouri that year.  The balance of his work is comprised of complex managed health care litigation, Qui Tam (FCA), trade secret claims, tortious interference with contract and fiduciary obligations.   Casey has been named to the prestigious American Board of Trial Advocates (ABOTA) and sits on the Boating Industry Risk Management Council (BIRMC). 

Licensed in Kansas, Missouri, Oklahoma, Texas and Iowa, he has jury-tried wrongful death cases, including severe burn injuries and amputations. He has also tried cases involving state merchandising practices and consumer protection acts.  His other representations include:

  • Defense verdict in a $15 million wrongful death product liability case for the world’s largest boat manufacturer;
  • Defense verdict in a $30 million toxic tort case for chemical transporter;
  • Defended a chemical transporter in the largest chlorine release in U.S. history;
  • Defended Purdue Pharma in the Kansas AG’s opioid suit against the company;
  • National counsel for the world’s largest privately held insurance broker;
  • Defended Professional and amateur sports leagues and teams in traumatic brain injury (CTE) litigation;
  • Represented Monster Energy Drink against wrongful death claims;
  • Obtained summary judgment (8th Cir. affirmed) for the country’s largest anesthesiology group in which $1 billion in damages were alleged for FCA violations. 

Casey has also successfully argued appeals before Kansas and Missouri appellate courts and the 8th and 10th Circuits. 

In addition to his jury trial and appellate experience, Casey is a Certified Fire and Explosion Investigator (CFEI) through the National Association of Fire Investigators (NAFI). He is a member of the National Fire Protection Association (NFPA) and has been peer-selected to serve on the NFPA 302 & 303 committees for watercraft and marinas. He has also been a task force member for NFPA 921 – The Guide for Fire and Explosion Investigations. He routinely speaks at national conferences regarding fire investigations, burn injury management, product liability, flammable vapors, complex settlements and insurance coverage.  

Casey attended Northeastern Oklahoma A&M, where he played baseball and is a Norseman Sports Hall of Fame Member.  He graduated from the University of Kansas and attended law school at KU.

Representative Matters

Carroll v. Sea Ray
Casey received a defense verdict in a wrongful death boat explosion case tried in the United States District Court for the Western District of Missouri.
Green v. Arizona Cardinals
Casey represented the Arizona Cardinals, a franchise of the National Football League, against claims that a player sustained CTE as a result of playing professional football.
Yummy Foods v. Lockton
Casey represented Lockton Companies against claims that Lockton failed to procure insurance for a landlord that sustained a total fire loss to its building.
Felts v. Monster Energy
Casey represented Monster Energy Drink in a wrongful death suit where it was alleged that plaintiff sustained a fatal heart attack after consuming a Monster Energy drink.
Martin v. Survivair
Venue: Circuit Court of St. Louis City, Missouri.  A jury trial involving a $27 million-dollar wrongful death claim related to a fire fighter’s death.
Morrison v. Survivair
Venue: Circuit Court of St. Louis City, Missouri.  A jury trial involving a $27 million-dollar wrongful death claim related to a fire fighter’s death.
Williams v. Brown and Williamson Tobacco Corp.
Venue: Circuit Court of St. Louis City, Missouri. A $30 million-dollar wrongful death product liability jury trial related to alleged defects in cigarette caused by an individual smoker’s death.
Townsend v. Soresco Chemical
Venue: Platte County, Missouri Circuit Court. A $30 million-dollar toxic tort exposure to PCBs brought by a Missouri Highway Patrolman. This defense verdict ranked as the 5th largest defense verdict for the year.
Kalbfleisch v. Willowbrook Foods
Venue: Circuit Court of Warren County Missouri. A claimed $2 million-dollar jury trial involving a truck accident that caused the plaintiff’s paraplegia.
Rider v. YMCA of Greater Kansas City
Venue: Circuit Court of Jackson County. A claimed $6 million-dollar jury trial for premises liability where plaintiff’s fall resulted in an amputation which included a claim for punitive damages.
Jordan v. Altec Industries
Venue: Circuit Court of Jackson County, Missouri. A claimed $3 million-dollar product liability jury trial related to an aerial device that failed causing the plaintiff’s paraplegia.
Solia v. WetSeal
Venue: United States District Court of Kansas. Jury trial alleging violation of the plaintiff’s civil rights related to false arrest and imprisonment with attendant claims for emotional distress.
Donegan v. AAKC
Venue: United States District Court for the Western District of Missouri. Summary judgment obtained in favor of defendant where relator claimed a billion dollars in damages for violation of the False Claims Act related to anesthesia services. The judgment was upheld by the 8th Circuit on appeal.
State of Kansas v Purdue Pharma
Venue: Shawnee County, Kansas. Represented defendant opioid manufacturer in claims brought on behalf of the State by Attorney General alleging violation of the KCPA in marketing and distribution of opioids.
St. Luke’s v BMI
Venue: Jackson County, Missouri. Dismissal of alleged violations of the Missouri Prompt Pay Act with pendant claims for breach of contract and promissory estoppel based on managed health care network participation.
