Practice & Activities

  • Casey spent his first 19 years at an international law firm before joining SWR in 2015.  He has been repeatedly named by his peers to “Super Lawyers”, “Best’s Lawyers” and “Best of the Kansas City Bar” and is “AV” rated by Martindale Hubbell and American Lawyer’s Magazine. 
  • As a trial lawyer with over 25 “first chair” jury trials, he defends companies, insurers and their insureds in product liability, toxic tort, mass tort and other catastrophic personal injury defense cases including class action cases.  A recent class action case he defended involved the largest chlorine release in U.S. history.  The balance of his work is comprised of professional liability, errors and omissions, directors’ and officers’ liability, Qui Tam defense and general business litigation.
  • Licensed in Kansas, Missouri, Oklahoma, Texas and Iowa, he routinely appears in state and federal courts throughout the Midwest.  He has defended clients against allegations of wrongful death, severe burn injuries and other catastrophic personal injury.  He has also tried cases involving state merchandising practices and consumer protection acts.  In his most recent jury trial, he obtained a unanimous defense verdict for an electrician who was alleged to have caused a fire that destroyed the Plaintiffs’ home.
  • Some of Casey’s successful defenses of notable jury trials with high settlement demands include:
  • A $27 million wrongful death jury trial including a claim for punitive damages. A $20 million wrongful death jury trial including a claim for punitive damages. A $30 million wrongful death jury trial. A $30 million toxic tort jury trial that ranked as Missouri’s 5th best defense verdict that year. A $2 million jury trial involving paraplegia injuries. A $6 million jury trial involving an amputation and a punitive damages claim. A jury trial alleging violations of the plaintiffs’ civil rights with attendant claims of emotional distress. A $3 million jury trial involving paraplegia injuries. A $1 million trial for property damage.
  • Casey has represented sports leagues and teams in traumatic brain injury (concussion) litigation.  He has represented a prominent energy drink manufacturer against claims that its product caused a consumer’s death.
  • He obtained summary judgment in favor of the largest anesthesiology group in the country which was sued alleging $1 billion in damages for violations of the False Claims Act. This decision was recently affirmed by the 8th Circuit Court of Appeals.
  • Casey has also successfully argued appeals before appellate courts of Kansas and Missouri as well as the Eighth and Tenth Circuits.
  • In addition to his jury trial and appellate experience, Casey is a Certified Fire and Explosion Investigator (CFEI) through the National Association of Fire Investigators.  He is an active member of the National Fire Protection Association and has been peer selected to serve on two different NFPA Committees that promulgate fire standards.  He has also been a task force member for NFPA 921 – The Guide for Fire and Explosion Investigations.  He routinely speaks at national conferences regarding fire investigations, burn injury management, products liability, flammable vapors, complex settlements and insurance coverage.
